| More states need 1% culpability laws. For example, a man I knew was walking around a boat store. Some bright orange chocks were left out after they moved a trailer. He tripped on them and hurt his knee pretty bad. He's about 300 pounds and diabetic, so you can imagine the knee damage he could do...
Anyway he talked to a lawyer about suing for medical bills. It turns out, in North Carolina, one of three states like it, if you are even 1% culpable for the accident, you can't sue someone else for it. The first question they asked was "if you were paying attention could you just have stepped over the chocks?"
"yes"
"no lawsuit..."
Boom. End of problem. Everywhere should be like that. I wish I would have been on stellas jury... "how many times has she drank coffee before? Tough...she learned a lesson."
I read somewhere else mcdonalds appealed the lawsuit and Stella got a lot less than the original amount. It went down to either 750K or 250K, I can't remember, still a lot, but less than 1.9M$
